Section 889

Section 889 is a provision within the NDAA that prohibits the use of certain telecommunications and video surveillance equipment and services from specific companies considered a potential threat to national security. FAR Rules Issued by DoD, GSA, and NASA

DoD (Department of Defense), GSA  (General Services Administration), and NASA (National Aeronautics and Space Administration) issued multiple rules amending the Federal Acquisition Regulation (FAR) to implement section 889 of the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2019 (Pub. L. 115-232)

Section 889 (a)(1)(A)

Section 889 (a)(1)(A) of the Federal Acquisition Regulation (FAR) prohibits US Government agencies from procuring or obtaining equipment or services that use covered telecommunications equipment or services as a substantial or essential component or critical technology. (FAR 52.204-25)

The following list are the covered entities and their subsidiaries and affiliates:

  • Huawei Technologies Company

  • ZTE Corporation

  • Hytera Communications Corporation

  • Hangzhou Hikvision Digital Technology Company

  • Dahua Technology Company

As expressed:
 

 “Covered telecommunications equipment or services,” as defined in the statute, means—

  • Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

  • For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

  • Telecommunications or video surveillance services provided by such entities or using such equipment; or

  • Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Section 889 (a)(1)(B)

 

Section 889 (a)(1)(B) prohibits US government agencies from contracting with any entity that uses certain telecommunications equipment or services produced by the entities listed above.

After conducting a reasonable inquiry for purposes of this representation, the offeror (Logical Commander Software Ltd) represents that it does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services adopting the rule in accordance to the definition of critical technologies included in the Foreign Investment Risk Review Modernization Act of 2018 (FIRRMA) (Section 1703 of Title XVII of the NDAA for FY 2019, Pub. L. 115-232, 50 U.S.C. 4565(a)(6) )(A)).
